Terms of Use

These Terms of Use ("Terms") govern your access to and use of the Insightful platform, website, and services (the "Service"), operated by Magellan Financial ("Insightful", "we", "us"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

Insightful is a funnel-building platform that lets you create, publish, and analyze interactive quiz and lead-generation funnels, collect responses and contact details from your visitors, and manage the resulting contacts. We may add, change, or remove features of the Service over time.

2. Accounts

You must provide accurate registration information and keep your credentials confidential. You are responsible for all activity under your account. Notify us promptly if you suspect unauthorized use of your account. You must be at least 18 years old and using the Service on behalf of a business or professional purpose.

3. Your content

You retain ownership of the funnels, text, images, logos, and other content you create or upload ("Your Content"), and of the visitor responses and contact data collected through your funnels ("Your Leads"). You grant us a limited license to host, store, display, and transmit Your Content and Your Leads solely as needed to operate the Service on your behalf.

You are solely responsible for Your Content, including having the rights to any images or brand assets you upload, and for the accuracy and legality of any claims your funnels make.

4. Your responsibilities for lead collection

When you collect personal data from visitors through your funnels, you are the data controller for that data. You agree to:

• Comply with all laws that apply to your collection and use of visitor data, including applicable privacy, telemarketing, and email marketing laws (such as TCPA, CAN-SPAM, and, where applicable, GDPR or state privacy laws)
• Provide any privacy notices or obtain any consents required for your collection and use of visitor data
• Comply with any advertising and disclosure rules that apply to your industry, including financial services regulations where relevant
• Use Your Leads only for purposes the visitor would reasonably expect from the funnel they completed

5. Acceptable use

You agree not to use the Service to:

• Violate any law or the rights of any person
• Publish content that is deceptive, fraudulent, defamatory, or discriminatory
• Impersonate any person or organization, or misrepresent your affiliation
• Send spam or collect data from visitors under false pretenses
• Upload malicious code or attempt to probe, disrupt, or gain unauthorized access to the Service or its data
• Resell or provide the Service to third parties except through funnels you operate

We may suspend or remove funnels or accounts that violate this section.

6. Fees

Parts of the Service may currently be offered without charge. We may introduce or change fees for the Service or particular features with reasonable advance notice. Continued use of paid features after a price change takes effect constitutes acceptance of the new fees.

7. Intellectual property

The Service itself — including its software, design, templates, and branding — is owned by us or our licensors and is protected by intellectual property laws. These Terms do not grant you any rights to our trademarks or branding. Feedback you provide about the Service may be used by us without obligation to you.

8. Availability and changes

We work to keep the Service available and reliable, but the Service is provided without guarantees of uninterrupted availability. We may modify, suspend, or discontinue the Service or any feature at any time, with reasonable notice where practicable. You are responsible for exporting Your Leads periodically.

9. Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL MEET YOUR REQUIREMENTS OR PRODUCE ANY PARTICULAR MARKETING RESULTS.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SERVICE WILL NOT EXCEED THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE, OR ONE HUNDRED DOLLARS IF YOU HAVE PAID US NOTHING.

11. Indemnification

You agree to indemnify and hold us harmless from claims, damages, and expenses (including reasonable attorneys' fees) arising from Your Content, Your Leads, your funnels, or your violation of these Terms or applicable law.

12. Termination

You may stop using the Service and request deletion of your account at any time. We may suspend or terminate your access if you materially violate these Terms. Upon termination, your right to use the Service ends; sections that by their nature should survive (including Sections 9–11) will survive.

13. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will provide notice (for example, on this page or by email). Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

14. Governing law

These Terms are governed by the laws of the State of Arizona, without regard to its conflict of law principles. Any disputes will be resolved in the state or federal courts located in Arizona, and you consent to their jurisdiction.
